Pending EEOC Case

I just learned that the person who discriminated against me while I was at work, has been seperated from the company while my case is still pending with EEOC. I beleive my case is partly the reason. What happens to my case now?

It probably will not affect your EEOC case because the company's defense will likely remain unchanged. It would have a larger effect if you filed suit against your company in federal court and were able to use discovery methods to learn about the basis for his firing.

The separation of the individual should not affect your claims at the EEOC. As a matter of strategy you should see a difference because the circumstances of this person has changed and the company will not have him/her as a captive audience. All things being equal this should help your case. He does not have to continue working for them in order for you to prosecute your case
