Legal Question in Employment Law in New York

can i get my severance

my self along with several others worked for Tyco/Sherwood Davis & Geck in Argyle NY, as a United stellworkers facility making medical products. The company closed operations and moved a mijority of the plant to Mexico! The local negotiated a closing deal with the company that was never voted on by the membership, and agree that severances would be paid to those who stayed until the ''Company'' decided to terminate their employment, anyone who terminated there employment prior to this date would not receive severance! HOWEVER.... one employee entered the HR office quit her job and also assaulted the HR secretary by throwing her time card at her striking her in the head!! She ''WAS'' paid her severance and the local faught for her to get it! Myself along with others filled out our teremination papers and crossed out the word VOLUNTARY anfd wrote involuntarily, and stated that we had terminated ourselves out of necessity for our families due to plant closure! when we tried to get the local to fight for us they refused and I have that in writing signed by the local president! Had the plant not shut down I would still be there along with the others, why did I not get my severance, when one employee who just up and quit did?
