civil burn case against lanlord

My case has been going on since Jan 2006, we have finished discovery and are now deposing of the witnesses. My 17month old child wad badly burned from the bathtub water that he fell into. He had 2 blood transfusion as well as a skin graft and 2 additional operations with possibly more due in the future. Water temp was read above 180 during visits from the city as well as being caught on video, water was so hot it cracked my ne sink. Acs found it was an accident. How long does it take to get an actual trial date and how long have you seen cases like this go on?

While you state that all discovery is finished, you also state that depositions are still going on. Depositions are in fact part of the discovery process, and many times those depositions lead to more discovery. So you should be aware that discovery is still ongoing in your case. In terms of the time to get this case to trial, that is difficult to say. After discovery is all completed then a Note of Issue is filed placing the case on the trial calendar. The court then sets it down for a pre-trial conference which could turn into a number of conferences before it is actually assigned a trial date. In addition, you state that the City is involved as a defendant,and due to the backlog of cases generally and with the City in particular, their role as a party many times means a longer wait. I am also assuming you have an attorney representing you and you should be able to obtain this information from your attorney.
