Served a summons

I was just served a summons for an auto accident my son was involved in 2 years ago (he driving my car). Accident was minor, but plantiff is claiming permanent injuries. Never been involved in this before...what do I do now?

You need to immediately contact your automobile insurance carrier and advise them of this lawsuit. Part of your coverage includes their obligation to provide you with a defense and assign an attorney to represent you. Call your insurance carrier immediately. Advise them of the law suit. They most likely know about it already because the Plaintiff's attorney has probably attempted to settle with your carrier without success.

Obtain the claim number, the name of the bodily injury adjuster and importantly, the address for the adjuster (insurance companies have numerous locations) and mail the Summons and Complaint to your adjuster. I would recommend Certified Mail, Return Receipt Requested or FedEx.

If you don't forward the complaint to your insurance carrier in a timely fashion, there is a chance they may disclaim for your lack of cooperation.

Once the carrier acknowledges receipt, they will retain counsel to represent you at no charge to you(that's why you pay premiums). Cooperate fully with the attorney.

Make sure you notify the carrier that covered you at the time of the accident.

Immediately turnit over to your insurance agent and/ broker and insurance carrier.

Speak with no one other than them or their representatives.
