Legal Question in Real Estate Law in New York

Eviction

I recently purchased a home in a foreclosure auction. I have closed on the house, but the previous owners currently live there. Among the 10 or so people living there is the grandmother, 75 years old. Are there any NY laws that would prevent the eviction of this person or any other disabled person? Are there any legal restrictions to evicting people?

thanks!

Re: Eviction

Are there any NY laws that would prevent the eviction of this person or any other disabled person?

A. Generally, no. However, there is some recent ligitation concerning people that are on Federal subsidy. It is too complicated to explain in this answer.

Are there any legal restrictions to evicting people?

A. If the person is disabled, before the Warrant is enforced the Department of Social Services should generally be contacted. This is true in NYC.

Mike.

Re: Eviction

There are no laws that prevent the eviction but there may be certain requirements that may need to be met before proceeding. It would be highly advisable to have an experienced attorney representing you. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination.
