Legal Question in Real Estate Law in New York

Fence dispute

My survey shows my property ends 5'6'' from my home and there are fence post that run from 5'1'' to 5'5'' away from said side, does that make the fence mine? The fence was installed when the home was built just over a year ago and from what I can see the post are ''ALL'' on my side of the property line as is the majority of the fence. The fence is also installed with the ''GOOD / SMOOTH'' side facing my neighbor. So, is it my fence?

Re: Fence dispute

I am confused by your question. Basically, how far is the fence from you home? If the fence is within 5'6" from your home - which is the property line - then the fence is located on your property and it is your fence. If the fence is located more than 5'6" from your home, it is your neighbor's fence.
