Legal Question in Real Estate Law in New York

My ex husband and I took out a mortgage together in 2005 for

a mobile home. When we seperated in January 2009, he

sexually assaulted me resulting in an order of protection in

effect for 3 yrs. I have since been living in the home with

my current husband and assumed the loan, never refinanced

because my credit had been ruined by my ex, and the bank

wouldn't refinance anybody. Now we would like to buy a new

home and sell this one but my ex's name is still on the

title so I know I would have to have him sign it. What is

the best course of action for me to take with an order of

protection in place? I was thinking of having a neutral 3rd

party hand him a contract I've drawn up and have him sign

the title. Is this legal and is this all I need to do?
