Maybe, at best, but more facts are needed. Why did the checking account have your brother's name on it? Was it merely as an accomodation to assist your father if he could not sign a check, or did your father actually want him to inherit any balance if your father died? Who is named as beneficiary of the insurance? If you are a named beneficdiary, you share in the policy. Litigation against your brother may be required.
