Legal Question in Wills and Trusts in New York

My mom died intestate. Personal property is under $20,000 but there is real property (value $65,000). Dad is still alive as are my adult brothers & sisters. Can I fill out Petition for Letters of Administration (using the forms on the NY court system site) myself or must I retain an attorney?

This can be done without an attorney, but an attorney is suggested as many facets of an intestacy (dying without a Will) probate can be tricky and beyond the ability of a non-attorney to handle correctly.

I strongly suggest you hire an attorney. I agree with Mr. LeVine, probate can be tricky, especially if challenged. It must be handled correctly from the outset.
