Legal Question in Workers Comp in New York

Workers Comp Injury

My husband had a workers comp injury and the nys state comp never settled with him. They're telling him that he needs an attorney to do so because it has been five or so years...we have been trying to get in with the doctor who treated him in the hospital and in office and they are refusing to see him under the comp case. Does he have a chance of getting the settlement from NYS comp board and how?

A claimant can settle their comp case. Some Workers Compensation Attorneys offer a free consultation. I suggest that you go to the comp board and print out your file. Take it and go see a comp. attorney in your area who does offer a free consultation. With the file in hand the attorney can advise you of your options in a non binding way. If you then want to try to do it your self you can do so. On the other hand, hiring a comp attorney is very inexpensive, much less expensive than a Personal Injury attorney. If it were me i would probably hire the lawyer to help.
