Legal Question in Bankruptcy in North Carolina

converting from chap13 to chap 7

we have been in chap13 for 2 years and were wondering if we could convert to a chap 7 because it is very hard to pay our expences even now.

Re: converting from chap13 to chap 7

Yes--you have a constitutional right to dismiss a

chapter 13 at any time under the prohibition

against involuntary servitude. You can also

generally convert to a chapter 7, as long as

there has not previously been a conversion.

Either may carry nasty consequences, though--

would need a lot more information about your

case to advise on them. They can include

garnishment of wages and siezure of assets by

creditors, etc.
