Legal Question in Credit and Debt Law in North Carolina

I am on disability & received a Execution for Collection. Recently I filled out an exemption form & listed my ONLY vehicle as exempt. The sheriff is telling me that they did not exempt my vehicle & that they can take it if they want. I am a single mom on disability with 2 children. Is this true ??

I don't know as I cannot see the exemption form that you filled out. It does not matter if this is your only vehicle or not. It matters whether the vehicle is owned free and clear and the value of the vehicle and if the vehicle is owned or partly owned by someone else.

There is no wage garnishment in NC but disability benefits (is this is SSDI/SSI) are exempt.

I can review it for you. Please contact me at [email protected] if interested.

Otherwise, if the car is not exempt, you may have to work out some kind of paymentt arrangement on the debt to prevent the car from being taken. Either that or file bankruptcy.
