Banking while separated

My Son lives in Winston-Salem, North Carolina.

He is presently separated. His Attorney told him that he cannot open Checking/Savings Accounts because his wife is allowed to get to these accounts.

Because of this, he has checks he has not deposited which would help give him interest. In order to pay his bills, he has to get cash from these checks and I guess use money orders to pay bills.

I've never heard of this, is there any way that he can open a checking/savings account at a bank? Please help, he has little assests and needs to start building for his future. Thank you.

That's not true-- whatever he makes after they separated is his own money that the wife is not entitled to. Maybe the attorney meant that if he co-mingles marital money (money earned while they were both married and before separation) with money currently earned, the wife may claim it's hers? He should consult with another family law specialist in Winston-Salem. Good luck.
