Legal Question in Family Law in North Carolina

father and grandparents rights to visitation

My son is separated from his wife (not legally) and she has left without telling him or us the address or correct phone number (she gave us a fake one). There is no way to contact or drive to a location to find my granddaughter. What rights do we have in this area also what laws are effective in this situation? His mother enlaw said she did not have to tell them since they were not divorced. Thanks for your help...A worried grandma

Re: father and grandparents rights to visitation

Since there are, apparently, no court orders

in effect, your husband's wife has not violated any laws, and she may continue(with the help of relatives) to secrete herself and your granddaughter.

There are many ways to find people in the United States and, you will have to take steps to initiate an investigation to find where this mother and daughter are (probably in the area where your son's mother-in-law resides).

If you and your son are unsuccessful in this search, you may need to engage the services of a private investigator.

Once the mother and child are located, your son

may wish then to sue for custody or at the very

least establish his right to visitation ordered

by the court along with his right to be kept

informed of his daughter's whereabouts at all times.
