Legal Question in Family Law in North Carolina

If I am unemployed and receiving child support for my 5 year-old son, can that child support I receive be used as income when calculating the child support I have to pay to my ex-husband for my two daughters that live with him? I also have a 4 month old son and choose to stay at home with him.

Child support you receive is typically not calculated as income in determining your child support obligation. However, simply because you "choose" to stay at home with your 4 month old and presumably have no income doesn't mean you won't have to pay support. Income can be imputed so that you will be obligated to pay child support even though you may actually not have any income. Best of luck!
