Legal Question in Civil Litigation in North Carolina

He used me

I loaned an ex-fling of mines $250.00 dollars. Being a foolish girl in love I didn't make him sign a promissary note, but it was definitely verbally agreed that he would pay me back. I tried to be reasonable because we were friends, but he has already broken two pay dates. And I just want to be through with him. I want to know if our verbal agreement will hold up in court, and if I can sue for mental anguish, or pain and suffering, because he just really stressed me so bad it's been over a year, and it just really pisses me off. I also want to know could I add an interest rate because its been over a year?

No mental anguish or pain and suffering available. No interest until you get a judgment against him. You would be able to recover your filing fee. The oral contract would be enforceable but it would be a swearing match between the two of you. You could try bringing a claim against him in small claims court. The magistrate's office would have the forms you need.
