Legal Question in Civil Litigation in North Carolina

Police failed to investigate

My child was molested by a 47 yr. old teacher and by a 27yr. old. Statutory and sex crime charges were filed. The problem is that the city police dept. had prior allegations that were never investigated on another child. Also the school system transfered this teacher to different schools and obviously did not do a background check because he has a criminal record. Do I have a litigation case?

Re: Police failed to investigate

You might have a case against the school system for e.g. negligent hiring or retention. It is difficult to sue the police in this situation, primarily due to something called the "public duty doctrine." You probably need to consult an attorney with more facts.
