Prescription drug use

If you pop positive for urinylisis for percocet but you had a prescription of them from 8 months ago and it shows in your medical record and they are charging you under article 112a. can they do that?

Yes, but.

They are charging you for misuse of the prescription.

Technically they are correct. However, I've had some people acquitted in such circumstances, depends on the facts, your reputation in your unit, and whether your leadership would support you.
