Legal Question in Real Estate Law in North Carolina

I have a home mortgage in my name alone, with the title of the home in my husband and my name. We have been seperated for 10 months ( I live at another residence) and I have continued to pay 40% of the mortgage on this home that he lives in. The home is on the market for sale and he is refusing to show the home and says he plans to stay there. I need to sell the home to get the mortgage out of my name, he will not communicate with me and refuses to show the home; additionally, we have an offer and he refuses to accept. What legal rights do I have to sell the home? Also, I have offered to him to refinance the home and place in his name solely, and he refuses. Please help~

I'm not exactly sure what to tell you. You probably should consult a domestic attorney if you don't have one already. Your options probably are along the lines of getting a separation agreement or settling this through the divorce.
