Legal Question in Criminal Law in Ohio

Ex-Offender

I served an 18-month sentence in Ohio State Reformatory in 1989-1990. I had previous misdemeanors so I was told that I can't get my record expunged. What are my legal rights to own a firearm for hunting or just to go to a shooting range? I have had no problems since my release in 1990.

Re: Ex-Offender

Under Ohio law, if you have ever been convicted of a felony offense then you are not permitted to possess a firearm. This includes a hunting rifle. There are ways to be relieved from that disabiilty, and expungment is the most common way. However, you were properly advised that you do not qualify for expungment if you have had two or more convictions.

It does not appear that you will be able to legally own a weapon or to legally possess a weapon in order to hunt (except bow-hunting). Your case illustrates the problem with a system that has a life-time look-back period for expungment.

There are ways to seek a governor's pardon, clemency, or restoration of your right to possess a firearm. However, those processes are expensive and there is no guarantee of success.

If you want to look into this area further, give me a call.
