Benefit Packaging

Could you please tell me if it is legal to offer different benefits packets, in particular, pension plans - to employees that fall within different job classifications?

Re: Benefit Packaging

The situation that you described is probably legal. However, without knowing the entire situation, I cannot answer your question absolutely. If the pension plans are simply based on job classifications and no other criteria, then the plan probably does not violate any laws. If, however, the plan takes into account other criteria such as race, gender, religion, or national origin, there may be a question as to whether the plan is discriminatory. I would suggest that you go to an attorney of your own choosing to discuss the entire situation to see if any laws have been violated.
