Legal Question in Wills and Trusts in Ohio

mothers death

my sister was named exec. of my mothers estate. there is only the two of us left.i felt we should sell the house and divide the money equally between the two of us.she gave the house to her son, and left me outin the cole. can anything be done about this? she is in ohio.

Depends on what the Will said to do with the house. If mother died in Ohio and the Will was probated in Ohio, then this is an Ohio question and not one for Indiana.

A couple of questions need to be answered in order to answer your questions!

I assume that mom had a will since your question states that your sister was named the executor of mom's estate. If that is true, then the house goes and all of mom's "probate" assets should go to the people named in the will.

I am also assuming that mom owned the house at the time of her death, the house was located in Ohio, and there was not deed that directly transferred the title to your sister or her son upon mom's death.

I agree. Unless the home was owned jointly with your sister or TOD or life estate to your sister, the home should have been transferred according to what your mother's will said.

You might want to investigate what the will said, and if the executor did not follow those instructions, file and action in the court.
