Legal Question in Wills and Trusts in Ohio

My Mother's passing

My mom has just passed away and my sister made her put all her money into her name because she knew she was ill and took advantage of the fact she was in a nursing home and she lived close and visited every day. there is a will but it seems to be no good now, since my sister has my mom's money in her bank account now.

Is all the money hers, or will she have to show the will to anyone?

Could she just destroy it? I have one brother and our dad is deceased.

Thank

Judy

Re: My Mother's passing

If all your mother's assets have been moved out of here estate and into your sister's name, there would be no reason to probate the will. The alternative is to prove in court that your mother was either incompetent or unduly influenced when she turned over all her money to your sister.
