Legal Question in Wills and Trusts in Ohio

Will needed to avoid Probate

What will do I need to have done to avoid going into Probate? I am trying to get information together for a will for my grandpa who has liver cancer and I am not sure where I should be looking and for what? We can not afford to go to a lawyer and have this drawn up so I am trying to do it myself. Any help would be greatly appreciated.

Thank you in advance.

Re: Will needed to avoid Probate

A Will does not avoid probate. A Will is actually an instrument of the Probate Court. It tells the Probate Court who to appoint as Executor and who receives the property. Your grandfather definitely needs to have a Will, but it will not avoid probate. Probate is not as expensive as financial planners claim. There are numerous other ways depending on the type of asset to avoid probate. I cannot adequately cover this topic here. Also, your grandfather should have a power of attorney for financial and health care matters. A Will and powers of attorney are inexpensive.
