How to file a small claims debt against a family member?

My bother-in-law owes my husbands money on several different debts. He now has the money but refuses to repay my husbands his portion of the debts. How can we take him to court and try to get our money back? We are taking about the sum of $2500.00. It really isn't enough money to hire an attorney. Please advise.

You can file a small claims action against your brother-in-law. You will need to obtain a small claims affidavit from the court clerk of the county of your brother-in-law's residence. The clerk will be able to assist you in preparing the affidavit. Good luck!
