banning people from my property

My 28 yr. old grandson has lived with me the past several years. He has people to the house that I do not want here. They smoke pot & drink alcohol essessively. I have has lots of valuable item stolen from me. He said I can not stop him having the people over. What can I do. He does not pay rent.

There are a variety of ways to deal with this problem, but it can be quite complicated. We first have to determine whether your grandson fits the definition of a "tenant" under the Oregon Residential Landlord Tenant Act.

If he is a "tenant", then he has certain rights and there are specific rules to be followed to remove him from the house. Payment or non-payment of rent alone does not determine whether he is a "tenant" under the law.

If he is not a "tenant" under the law, then we have to follow a different set of rules.

Since you say he is your grandson, there is also the possibility that we can use the elder abuse statutes to remove him.

Making these determinations often lies on specific facts related to your individual situation. Making the wrong determination could result in losing and your grandson remaining in your house. You could even end up paying for his attorney.
