Legal Question in Personal Injury in Oregon

I had an incident last night. I had two kids with me and I was shopping at a local Target store. The smaller child was sitting in the seat of the cart and the bigger child was sitting in the basket (one was little under 2 and one was barely older than 2.) The child in the basket stood up momentarily to fix her coat, but as soon as she did that, the locking mechanism on the cart activated and the child fell out of the cart and hit her head on the cement. My issue is that there is NO warnings, labels, instructions of any sort on the cart or inside the store that indicate that the carts lock. If I had known that, I would not have attempted to push the children to the other side of the parking lot. The child went to ER and was released with a "minor head injury" but I have go back for several check-ups and issues may arise later. My question is whether I have a case, and whether it would be worth my time and effort to pursue one. My insurance will likely cover the medical bills, but I feel like with all the stress and pain my daughter felt, some type of compensation is deserved.

You may well have a valid claim against the store for compensation. I do not handle this sort of case, but the lawyers at Kafoury & McDougal sue stores quite frequently for injuries to customers. 503-224-2647 or [email protected].
