Legal Question in Traffic Law in Oregon
Damage to Car
I was dog-sitting for my brother-in-law, who lives with me, while he was out of town. Dog got loose and got hit by a car. Dog is OK but lady who hit it has damage to her car. She wants me to pay for the damage but she doesn't want to go through her insurance, not sure why. How liable am I?

Re: Damage to Car
Typically, if a dog gets loose it's because your local leash law was violated, making you and/or the owner responsible for damage done as a result. Under those circumstances, the homeowner's insurance for the home where the dog lives will pay for the damage caused by the dog. If the car owner were to go through her OWN insurance, as you suggest, that insurance company would probably come back after you or your insurer for reimbursement, if you're legally responsible.
I'd suggest you call your insurance AGENT first, for your homeowner's policy, and inquire about coverage, before actually notifying the company itself.
Good luck to you. -- Sam
