Legal Question in Bankruptcy in Pennsylvania

Notice of hearing

At one point I had great credit w/ alot of debt. The past several years I have had a foreclosure, several charge-offs and now received an order to appear for one of my unpaid credit cards in local district court. The reason all of this has has happened is due to my need to stay home with my disabled child. He receives SSI and has a diagnosis. I can't pay any amount right now due to the need to provide for my family. What should I do? File a Bankruptcy? I have less than 1 month to find a solution.

If the creditor has sued in the local district court, the amount of the debt probably wouldn't put you in the range where bankruptcy would be your best option. What you should do is appear and defend. Frequently there are defenses in these cases such as the Statute of Limitations (4 years), inadequate documentation of the debt, lack of your signature, excessive interest, and some others. Even if there is no defense, the attorney representing the credit card company is usually willing to work something out.
