Legal Question in Consumer Law in Pennsylvania

Injuries

If another person assaulted me on Walmart property, would I have grounds to sue Walmart since it happened on their property?

What if the assault was an accident...say someone shoved me against a shelf passing by. Would I have grounds to sue Walmart for bruises on my back?

Re: Injuries

You asked if you could sue WalMart for injuries from a personal assault.

What is the nexus between the tortfeasor and WalMart? If WalMart had reason to suspect you may be injured in such a manner then they could be liable. This would apply if the individual was an employee the employer knew had a tendency for violence. Such as when people are thrown out of a nightclub by a bouncer.

Generally, a property owner can only be held liable for injuries which were foreseeable and for which it took insufficient precautions to prevent or minimize.

Here your claim would only be against the tortfeasor unless there was a sufficient nexus with WalMart.

Regards,

Roger
