Re: credit card debt

Only if the credit card company obtained a judgment within the four year period following accrual of their cause of action. The tricky question is when their cause of action accrues to start the ball rolling and with credit cards I'm not sure of any hard and fast rule in Pennsylvania. My argument is generally that it starts with the first missed payment since that's the point where they can sue. However, the flip side to that argument and one that I think most Courts will accept is that if there are ongoing payments, even if they are late, the statute stops running but starts again with the next missed payment when they again have the right to sue.

There are flaws with the second argument since it would logically follow that the credit card companies cause of action would not accrue if any payment at all was made, even if late., but I'm not aware of any cases analyzing this question in any depth.

Re: credit card debt

There is a 4 year statute of limitations. However, if you admit that the debt is yours, the four years starts over. Therefore, dont admit that its your debt and you should be fine.
