criminal conspericy and attempted robbery

my boyfriend has been in jail for almost 3 months now hes being held on attempted robbery and criminal conspiracy. he was with a friend who was released after 30 days on the same charges.my boyfriend is on probation for not telling on another friend for stealing. they have no proof there was going to be a robbery and no evidence. they were only sitting in a car behind a local mini market talking and a guy kept watching them by the time they got home police were there and arrested them both. how long can they hold him and what is the max for these charges in pa? his po will not release him even if his fines are paid in full and won't talk to him at all. he has a court date set for the end of may.

He can be re-sentenced on the charge for which he was on probation. He is on what is called a "detainer." The detainer can be lifted by the Judge that imposed the sentence on the theft charge but the Judges generally go along with the Probation Officers. As far as the maximum sentence a lot depends on the facts. Was your boyfriend or his friend armed? Did either of them go into the mini market?
