Legal Question in Discrimination Law in Pennsylvania

job firing

i was fired while on disability. my question is whether there is a time limit on any legal action. this happened 41/2 years ago. the story is much more complicated. At the time i could not afford a lawyer and I was unemployed. If there is still a chance to do something where can i go to obtain some legal advice to initiate proceedings. I would still find it very hard to afford a lawyer for this.

Re: job firing

You asked about statutes of limitations.

Civil matters and most criminal matters have what are called "statutes of limitations" which are periods of time in which all claims must be made or otherwise waived.

In many cases statutes of limitation are measured in years. One year for some civil claims, two years for many and four or more years for others.

In the case of disability claims made under the Americans with Disabilities Act or similar laws the claims must usually be made within 180 days of the adverse action. Further, most attorneys will take disability cases, based on the merit of the claim, for a percentage of any future award or settlement. Often, the employer is required to pay the lawyer's fee if the employer is proven to have discriminated.

In the case you state you are most likely outside the statutory limitation period. You should nevertheless sit down with an attorney and discuss the specifics of your matter to determine if there is any way to find an exception or if you are otherwise eligible to pursue your claims.

Regards,

Roger
