2nd dui
my brother had is 1st DUI 3 yrs just this week he feel asleep at the wheel hit a tree the hospital told us his blood alcohol level was .179
what will happen if he is charged with a 2nd DUI He does have his cdl licenses he broke jaw in 7 places and dislocated both his hips he was questioning to be what will happen

They don't care why he crashed, he was over the limit, the penalties will be based upon this being his 2nd DUI, and his CDL is gone. Perhaps if he was drinking he wouldn't have fallen asleep. A .179 is not a drink or two, either he has a drinking problem, or he needs to mature enough he can drink and NOT drive. He broke bones, so be thankful he will heal and did not die.
