Legal Question in Family Law in Pennsylvania

financial matters in divorce

I'm trying to find out if my mother and I hold an account together after I've been married, is my husband entitled to any of the money?

Re: financial matters in divorce

I am happy to consult with you on a free initial basis. It is very helpful to discuss all of the ramifications with an experienced family attorney. I have ten years' experience as a family law practitioner and am a former hearing officer with the Montgomery County Domestic Relations Office.

In the event of a divorce, Pennsylvania law provides for equitable distribution of all marital assets. Marital assets are defined as property acquired from the date of marriage to the date of separation. That includes any increase in value of what was premarital property.

As you can see, regardless of how property is titled, each spouse may have a share in it, with 2 exceptions. Property acquired through gift or inheritance is not marital, initially. Of course, any increase in value is marital.

I trust this has been helpful, but feel free to call or E-mail with any questions on a free initial basis.
