Motion for special Relief

My sister & her husband have been separated Her husband told his lawyer that her male friend moved i n the house she got a letter saying that they will file for Motion for special relief what is that? Her friend does not live with her.He visits her. They have 2 children that live with my sister. It said he has to leave in 15days or they will file that. but he does not live there. My sister lives in the house that they bought when they were together. They are not divorce yet.

A motion for special relief asks the court to order the parties to do something or to stop doing something. It is special as it is something the court might not normally order i.e. child support, equitable distribution.

You do not say how long the couple has been separated which is probably a relevant fact.

To prevail the husband is going to need more than just his say so. That tells me that they may have more.

If your sister doesn't have a lawyer now would be a good time to have one.

If nothing else is clear this now no longer a simple divorce.
