Legal Question in Family Law in Pennsylvania

Relocation and child custody

I live and work in MO. I my girl friend lives in PA. She is divorced and has one child. Her X-husband is a pilot for an airlines. He claims he will not let her take thier son out of state if we do get married. She has physical custody in a joint custody situation. The son is 2 years old. Is there a way we can go to court and have him forced to allow the son to move out of state? Since transportation is not an issue? The only real issue would be once the child started school. We are more than willing to let him see his son anytime he wants to and to have him over holidays and summer brakes. What are our chances of winning something like this in court? Your help would be greatly appreciated. Thank you for your time and effort.

Re: Relocation and child custody

From your post it appears that your girlfriend must have been divorced in PA, and I'm assuming that the custody order is from a Court in that state. Accordingly, the issue of relocation would be governed by the law of that stae, and in fact, the divorce court probably retained jurisdiction to decide any future issues regading the child. My advice would be to consult with her divorce lawyer or seek advice from any other competent attorney in that location.
