Legal Question in Civil Litigation in Pennsylvania

Kids and Broken Glasses

My neice placed her glasses on the floor beside the chair where my daughter was sitting. My daughter stood up, not seeing the glasses and stepped on them. My sister says that both children are equally responsible for the payment of the glasses. Who should pay for a new pair of glasses?

Re: Kids and Broken Glasses

I could go into a long analysis about children and responsibility and age and duty of care.

But you don't want that: You want an answer. Your niece is responsible for her own glasses. If they are not on her face they should be in their case in a safe location. The floor is never a safe location. Unless your daughter went stomping about the room haphazardly or was roughhousing, in which case she may have some culpability, I think the niece is responsible and this lesson will hopefully teach her to care for her glasses properly.

But let's also get real, neither child is responsible for the payment of the glasses. It's the parent who pays in the end.

Good luck and regards,

And let's get even more real...unless you want to have a family feud with your sister and go to court over a few hundred dollars...work it out.
