Motion To Strike

How to file a motion to strike a judgement for a sheriff's sale, when the suit was knowingly filed false.The person who filed the report for money was paid in 2004,

(have cancelled check) now is trying

to collect again. Did not receive a

notice of to answer the charges,found out when the Sheriff

came to drop the judgement paper

for the date of the sale.

I'm not clear on what you are saying. There is apparently a judgment against you that was not marked satisfied and the plaintiff is executing on that judgment. It sounds to me as if someone may have bought the judgment and is proceeding to execution on the judgment because it remains unsatisfied. You really need to hire an attorney to deal with this. When a judgment has been obtained and you pay the amount of the judgment you also have to tender the costs of satisfaction which are small and you ask for certification that the judgment is satisfied. The plaintiff then has to satisfy the judgment. This apparently wasn't done in your situation.
