My daughter left the state and former employer holding last check

My daughtermoved to another state and didn't pick her last paycheck.She asked me if I can pick it up for her.When I called her employer he said he would not give it to me and she would have to pick it up.He owns a small business and has known us for years.How can we go about getting her paycheck without having her come back to the state?If I get a letter from her giving her permission does he have to give it to me.My daughter is 20 yrs old.

You asked about getting your daughter her last paycheck.

You might have her call the employer and request he send it to her or allow it to be picked up.

It is an employer's duty to get pay to an employee within two weeks after the pay period ends. Failure to do so is a labor violation. If your daughter gets any push-back just have her mention "it's OK if he doesn't want to release the check. The state wage and hour enforcement can collect the funds more easily and audit for any other violations."

That should shake the check loose real quick.

No, your daughter does not have to return to get a paycheck she is owed.
