Old employer that emailed from my own AOL

I was terminated from my job because of my disability. Charges have been made to the government. The human resource director took my old password (passwords were the same) from my companies computer and used it to typed up a false email on my personal AOL account and sent this email to my lawyer. This fraudulent act of untrue information is being used as evidence in a trial against me. We already know this email was not typed from our computer we professionally had it check. Is this a unlawful act from the company.....and how do we prove this was done?
