Manager looking for the truth

My name is Ben and I have currently obtained a job with a fast food resturant. In my place I busness I am working in the management team as a salary employee. I work a minimum of 45 hours a week. My question is this....

I work five nine hour days a week. I am supposed to get a one hour paid break but that never seems to happen.. Its like its understood. My real question to you is does fed. or state law require that I recieve some sort of break or are they allowed to conduct busness this way. The reason I am asking is because my company has a no smoking polocy unless you are on break but unfortunatly I do not recieve my break. Thanks for your help!

Befor involving a lawyer you might get quicker and better results by speaking with your direct supervisor and letting him/her know that for whatever reason you have been unable to take any breaks. If he/she is a person worth working for then he/she should help you obtain the necessary break.
