Unfair Business Ethics

I am 55 working for the worlds largest department store in the same store for 35 years straight commission furniture sales. Over the last 2 years a recent acquisition of a competitor has left me as the lone survivor from the original staff that received severance. The acquired store has now rehired 2 of their previous severance associates and put them on the floor with me. I have had to train them on our systems without compensation. In return I am now losing income because the new associates undercut pricing so that if one of my customer's comes back in my absence, they just undercut the correct price that I quote under the company guidelines so that they now make the sale. I have brought this to the attention of district and regional management with no satisfactory change. I am also called upon to do the lions share of the presentation work to keep the floor looking crisp. This work falls on my shoulders because one associate has a bad heart, and the other a bad back so I am told. My belief is that from the top down my life is being made as miserable as possible because they are covertly attempting to get me to resign. I need to know what if anything I can do about this situation since I have exhausted all avenues. Thank-you.

Isn't it time to start thinking about your Employer's treatment as constituting an Age Discrimination Case? Make a notebook of all the facts and observations which support a claim of age-based unfair treatment. Take you notebook to a lawyer in a few weeks. Don't quit. Make them fire you.

You asked about potential discriminatory conduct.

This would appear to be a developing or potential claim under the Age Discrimination Enforcement Act.

You will need to provide a summary of all events up to date and from now on keep a diary of events. Also include details of your personal life, such as how you are doing, whether you are suffering from stress, whether this affects your personal relationships and so on.

Depending on how the matters shapes up you should speak with an attorney to determine if you have a claim. Be diligent as discrimination complaints must be brought within a short period of time after the discrimination arises or the claim may be lost.
