Re:Medical records:28 Pa Code 103.22-Pennsylvania's Patient Bill of Rights

Under Pennsylvania's Patient Bill of Rights (which are generally posted in doctors offices and hospitals), your wife, or her designee, is entitled to obtain on request all records of her medical treatment. Your wife, or a designee, needs to contact the hospital or doctors office and ask them how to obtain medical records. The provider is permitted to charge a reasonable fee for copies of records.

If your reason for seeking these records is that you believe your wife was injured by medical malpractice, you need to speak to an attorney as soon as possible. You may contact me through information on this website if you are interested.

Frequently, if an attorney believes that you may have a medical malpractice case, he will make the arrangements to receive the records.

28 Pa Code 103.22.

(15) The hospital shall provide the patient, or patient designee, upon request, access to all information contained in his medical records, unless access is specifically restricted by the attending physician for medical reasons.
