Automobile Accident - Injuries & Lawsuit ?

I was an accident recently and at the time, we (four of us) thought we were okay and did not request medical treatment, however after few days my back, neck begin to pain (lately migrane headaches) I called the passengers whom were in my car and asked how they felt, they also feel the same (one barely could lift his shoulder). We are planning to have it check up this coming week. My question to you is that can I file claim for medical expenses now even though when the report was filed with the police and later the insurance company when we told them we were OKay ?

Also, I strongly believe that accident was a result partly on the negligent of PennDot. They removed the pavement around the curve and filled with gravel WITHOUT putting any signs of construction or any alert for car approaching to the curve in reasonable distance. The rollover caused after the truck skidded and lost control as i was approaching on the curve.

Can i sue DOT for this negligent ? Folks i talked to told me to do so but I am still concern about the legal fees and what sort of stepts are needed ? Please let me know in details.

Yes, the medical bills can still be paid by your auto carrier so long as your doctor will explain why they are related to the accident. You certainly may have a claim against Pendott, however, the injury must be serious to proceed. You must have $1500 in medical bills and a permanent loss of a bodily function before you can sue Pendott.
