Legal Question in Immigration Law in Rhode Island

My common law husband is in the Houston Federal Detention Center in Houston, he is from Mexico. Is there a possibility that they will send him back after he completes his time in June eventhough we have a daughter together?

Yes, if he is living in USA illegally, then after serving his criminal sentence, he is going to be transferred into ICE (immigration) custody and referred to Immigration Court for removal to his native country.

Whether he has any chances to apply for any sort of status or immigration relief, is not clear from your post.

Having a minor child would not afford him right to request a stay or a green card. If you are legally married and a USA citizen, you could have petitioned for him (it's not an easy process, and depends on how and when he came to USA).
