automobile titles

I was a small pre-owned auto dealer in Charleston, SC. The store was closed on April 2, 2008. My wife was diagnosed with cancer, so I became an absentee owner for 5 months. My employees took advantage of this in many ways to include mismanaging funds and got behind on titles. These issues led me to close the business and I am also in the middle of bankruptcy. They sold a vehicle to a cutomer in Phil, PA and title was held by a floor plan company. The SCDMV told me several times that by law they can demand a title held by a floor plan company, and they have on others that I had. The dealer agent for SCDMV told this customer that they could not get the title and for him to sue me. I am looking for advice on what to do from here?? Can he sue and what legal rights do I have with SCDMV after what they told me.
