Legal Question in Criminal Law in South Carolina

Marijuana charge

Can i cancel the pti which i enterd into and just pay the original fine. I went to court on the assigned day, but the court was closed. I live in florida and the opffense was in south carolina, so i opted for pti, which was approved by judge. After i got all of the rules for pti, it is impossible to do all of the required things in 60 days and keep my job. Can i go back to original fine. The code is 92 offense, spmj 1st offense

Re: Marijuana charge

You have the right to quit PTI. However, when you do the case will go back to the Solicitor's office for prosecution. Whether or not you can just go pay the fine will be up to the Solicitor. Usually the prosecutor will not be seeking jail time on a SPM First Offense. So just paying a fine is possible. You can also talk with the PTI office and explain your circumstances and see if you can get more time or if other arrangements can be made. If you should need an attorney to assist you in getting through this without jail or a trial and to just pay a fine, I can help and wouldn't charge much just to get this through the system. My office is in Myrtle Beach, which is part of Horry County, but I work state-wide. You can click on my name for my number or email me at [email protected]
