Legal Question in Family Law in South Carolina

Dropping a charge

My fiance got abusive with me today and someone called the cops. I told them I did not want to press charges or for them to take him to jail. They said I had to...and they took him to jail. Now he is on a $45,000 cash or surety bond. I never wanted to press charges I was just doing as the police told me. What should I do? What can I do??

Re: Dropping a charge

The charges are not brought by you, they are brought by the State of SC. Therefore, they are not your charges to drop. There may be some options if the two of you get married, as the only witnesses to these types of incidents are the two of you, and spouses typically cannot be compelled to testify against each other.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced criminal attorney to find out what options are available to you based on the facts of your particular case.
