Legal Question in Insurance Law in South Carolina

long term disability insurance policy

I have a long term disability policy with Canada Life. I had a total hip replacement in May and have been scheduled for the left hip in October. I submitted all information and records to the company for this claim two months ago. I have not worked since april 4 2002 under doctors orders. The companys policy is that they will only take ten days to process a claim after all records are received. However that still have not done this, I guess my question is there a law to keep insurance companys fom givien you the ''run around''

Thank You ,

Re: long term disability insurance policy

I would try calling the supervisor, manager, etc. So far, I don't see where the insurance company is violating any laws. However, you should have either received an approval for your claim, or an explanation as to why not. It is possible to bring legal action against an insurance company, but it might be premature to do so just yet. You can also call the State Insurance Commission for guidance. Another option would be to have an attorney send them a wake-up letter, which usually gets their attention. I assume you have tried to follow up your claim with phone call(s). If not, that would be your first step. Good luck and call if you still need help and I would be happy to speak with you.
